Hogan failed to get a federal court to grant an injunction prohibiting its publication, but then found a state judge who granted his motion for an injunction. Today, a Florida appeals court overturned the injunction, explaining that given Hogan’s own public comments about his affair, that this was a matter of public concern and protected by the First Amendment.
