ECPA Violation Claim Dropped Against interclick

A press release from interclick:

interclick, inc. announced today that claims alleging violation of the Electronic Communications Privacy Act (ECPA) have been dropped against the Company as part of ongoing legal litigation.

In December of 2010, Sonal Bose filed a lawsuit, seeking class action status, against interclick, Inc. claiming, among other things, that interclick’s online behavioral advertising practices violated the Electronic Communications Privacy Act. On March 21, 2011, following interclick’s recent motion to dismiss, the plaintiff amended her complaint and voluntarily dropped her claim that interclick had violated the Electronic Communications Privacy Act.

“interclick believes that our activities are not, and have never been, in any way unlawful and violated customer privacy. We are pleased that this important element of the litigation has been dropped,” said Michael Katz, CEO of interclick.
