It seems like in the blink of an eye, Juror One’s motion for a temporary restraining order and preliminary injunction was dismissed by a federal court for lack of jurisdiction.
Juror Number One was due to appear in Judge Kenny’s court yesterday on the judge’s order to provide consent to access his Facebook posts. It’s not clear to me at this time what happened in that court appearance as I haven’t found any media coverage yet.
Thanks to Venkat Balasubramani for the link to the dismissal, although I’m beginning to suspect he’s secretly chortling about making me crazy with this case. 🙂
On a serious note, for those who don’t recall the case, there’s a serious issue here as to whether a judge can compel a juror to provide consent so that Facebook can reveal their posts. At stake is not only our privacy rights but the rights of a criminal defendant to a fair trial as the juror’s posts might have indicated bias or something that defense counsel could use. The issue has been in the courts for over a year now and you can find extensive previous coverage of the case on this blog.
If anyone finds out what happened in Judge Kenny’s court yesterday, please let me know.
