A Wyoming teen could sue her teacher for invading her privacy after the instructor wrote an inappropriate tweet about the student’s medical and academic information that led to the teacher receiving a 13-day unpaid suspension, according to Nelson Miller, associate dean for West Michigan University Cooley Law School in Grand Rapids.
“I’m sure the girl who is taking my economics class for the second time will make an excellent mom come December. #sarcasm,” tweeted the Wyoming Public Schools teacher, described as a 17-year veteran.

Miller, who practiced civil litigation for 16 years, said it does not matter legally that the teacher doesn’t name the student in the tweet. In Michigan, he said, there can be a cause of action for public disclosure of private facts – a civil suit against the teacher.
“There is no question she shouldn’t have sent the tweet,” he said. “The question is, how offensive is it? The teen would have to show that the teacher disclosed confidential information in a way that would have been ‘highly offensive to the reasonable person.'”
