Police must obtain a warrant to search a private home, even when a landlord or repairman enters first and spots potentially illegal activity, the state Supreme Court ruled on Tuesday.
In a unanimous opinion by Chief Justice Stuart Rabner, the court said the constitutional right to privacy is strongest when it comes to private residences, citing dozens of previous rulings. As a result, a man imprisoned in Monmouth County for keeping firearms and drugs with intent to distribute must get a new chance to suppress the evidence against him in a hearing, the court said.
