In a rare move, a federal appeals court overturned a lower court’s decision to allow a lawsuit to proceed as a class action, and criticized the conduct of the lawyers who brought the case.
The 7th Circuit Court of Appeals on Tuesday reversed the lower court’s decision to certify the class in a suit brought on behalf of recipients of so-called junk faxes. In its ruling, the court disapproved of the way the lawyers filing the class action recruited clients and found companies to sue.
