Ninth Circuit Cool to New Wave of Privacy Suits Under VPPA

Plaintiffs lawyers on Friday tried to persuade a Ninth Circuit panel to revive a pair of privacy suits brought under the Video Privacy Protection Act against digital video streaming services.

Federal judges in the Northern District of California tossed the proposed class actions against Netflix Inc. and Sony Computer Entertainment America LLC on motions to dismiss in 2012.

Yet another video privacy case is set to be argued before a separate Ninth Circuit panel on Wednesday. Deacon v. Pandora, 11-04674, was brought under Michigan state law, also by the Edelson law firm. Marc Zwillinger of privacy boutique ZwillGen PLLC represents Pandora.
