Privacy 3.0—A Reexamination of the Principle of Proportionality

Andrew B. Serwin, a partner with Foley & Lardner LLP, has an article in BNA’s Privacy & Security Law that is of note. It begins:

While there are many disagreements regarding privacy, there is general agreement that current privacy theory does not adequately address growing societal concerns regarding the use and protection of information. The importance of having a comprehensive and cohesive theoretical underpinning for privacy cannot be overstated. The failure to have consensus creates uncertainty for businesses and consumers alike, as it will result in a continuation of the patchwork, and at times inconsistent, approach to regulation that characterizes the laws of today.
