Proposal to strengthen ECPA makes it out of committee, but is it going anywhere soon?

I was so excited that I forgot to blog. Really. 🙂

This morning, the Senate Judiciary Committee held its markup of Senator Leahy’s manager’s bill for H.R. 2471.  The bill tacks on ECPA reforms to a bill that had passed in the House and that would relax some of the privacy protections in the Video Privacy Protection Act.

Despite objections from law enforcement agencies cited by Senator Chuck Grassley, who unsuccessfully attempted to expand exemptions to the warrant standard, the bill was passed by the committee and now goes to the full Senate. Sadly, it is not expected to pass this year. And when it does get to the floor, expect strong opposition from law enforcement who definitely don’t want a warrant standard.
