EPIC submitted a detailed statement to the Department of Education in response to a request for public comment on a proposal to expand exemptions in a law that protects the privacy of student information. The Family Educational Rights and Privacy Act limits the release of students’ educational records. However, the Department of Education has proposed to relax privacy safeguards to permit widespread disclosure of student data, including unique students identification numbers, across federal and state agencies. EPIC said that the agency lacks the legal authority to establish the exemptions and that proposal would result in an “Unprecedented and Unlawful Release of Confidential Student Information.” Individuals can submit their own comments on the Regulations.gov website.
