Supreme Court Hears Oral Argument in Kentucky v. King

Posted on January 12, 2011July 3, 2025 by Dissent

The Supreme Court heard oral arguments today in Kentucky v. King. The transcript of the argument can be found on the Supreme Court’s site.

For those not familiar with this Fourth Amendment case, the question before the court, as summarized by SCOTUSblog, is “Under what circumstances can lawful police action impermissibly ”create” exigent circumstances that preclude warrantless entry?”   They helpful translate that into plain English as

Although the police usually need a warrant to enter someone’s home, there is an exception for emergency situations. The question is whether that exception can apply when the emergency is created by the lawful actions of the police.

Orin Kerr comments on the issue and oral arguments on The Volokh Conspiracy.  Court documents related to the case can be found on SCOTUSblog.
